Our goal is also to provide you with advise, information and services, with the highest level of quality care and confidentiality during the entire process of your order. Sale By ordering on HOBBYDREAMS.EU you fully agree with these Terms and Conditions. The information mentioned on the website (electronic catalogue) is strictly indicative. HOBBYDREAMS.EU can be brought to modify it without warning. The pictures are not contractual. These conditions are valid in the EEC. For the other countries, please contact us. We will inform you about the particular conditions on timing, shipping costs and duty rates. 3. Guarantee remote sales The sales are concluded between KENOMAR S.A. – N.V. and its customers via HOBBYDREAMS.EU are subjected to the Belgium law of July 14, 1991 related to the consumer protection, modified by the law of May 25, 1999 on the remote sales. 4. Prices The prices indicated for the products distributed by HOBBYDREAMS.EU are in Euro all taxes included. Shipping costs are not included. Any modification of the delivery terms or even of the general terms of sales at the customer’s request may result in complementary invoicing if necessary. The prices of the products are however subject to changes at any time of the year. 5. Ordering The orders can be placed - directly on-line - by phone - by mail on printable purchase order - by fax on printable purchase order You choose the articles you want to order and put them in your shopping basket. After having filled out necessary information for the billing and the delivery, you confirm your order. An order becomes effective only after approval by HOBBYDREAMS.EU. The information given by the purchaser when ordering engages only him. If the order is incomplete or incorrect, the salesman cannot be held responsible if the products cannot be delivered. 6. Availability KENOMAR S.A. – N.V. cannot ensure the availability of all the products presented. If the ordered articles are available, the purchaser immediately receives a confirmation e-mail which establishes a valid contract between the purchaser and KENOMAR S.A. – N.V. . KENOMAR S.A. – N.V. will inform its customers of possible out-of-stock conditions affecting their order. Schedule of delivery will be provided for all goods. In the event the customer does not accept the delivery terms, the customer may cancel the order and will be reimbursed. 7. Delivery As soon as you have received the confirmation of your order, we pack your order carefully and we send it directly to you. For more information please read below the chapter expedition. The customer bears the risks of damage or loss of the products, no matter the means of transportation. The purchaser must carefully check the items at the moment of the reception and make written comments on the freight-bill if necessary. Any complaint must be sent to KENOMAR S.A. – N.V. by registered letter with acknowledgement of delivery within the 3 working days after the delivery of the articles. Without prejudice to the rights available to the purchaser as for the application of the law of May 25, 1999 and its ability to return the object delivered during the 7 working days following the reception. 8. Freight costs The freight costs are detailed on the page “expedition”. 9. Delivery limits A maximum delivery limit of 8 working days is guaranteed for most articles. The delivery timing indicates to you the availability of each article at the end of the reference line. We handle the majority of orders within the mentioned time limits. We cannot however exclude some exceptions, independent of our will (such as strikes, out-of-stock condition). Be advised however that these delivery limits are for your information only and that we cannot be held liable for possible delays, because we depend on the delivery regulations of our suppliers (stock and availability of the product). If the order cannot be handled within the mentioned time limits, we will contact the customer and he will then be able to confirm or cancel his order. 10. Payment You can either pay: - Cash the day of the order with credit card or home-banking by secured payment. Caution : with this mode of payment the shipping address will be the billing address of the owner of the card. - COD with payment cash at delivery, with complementary invoicing related to this operation. - By Electronic payement The order validated by the customer will be recorded by KENOMAR S.A. – N.V. only after agreement of the banking centres. In the event of non-payment, the order will be cancelled and the customer will be notified. 11. Guarantee As an intermediary, KENOMAR S.A. – N.V. limits the guarantee at which is granted to him, by its suppliers. KENOMAR S.A. – N.V. will limit in any event its intervention to the replacement of the defective products or the refunding of the paid price without the customer being able to claim the granting of damages. KENOMAR S.A. – N.V. will be in no manner held for responsible of the in execution by his supplier of his obligations relating to the execution of the guarantee, especially in the event of bankruptcy of the supplier. 12. Cancellation You have the right to cancel your order. In this case, you must send a registered letter within the 7 working days, which follow the reception of the goods. The products have to be returned in their original packaging, intact and complete. They will then be exchanged or refunded on the basis of purchase price minus the shipping costs. 13. Error or complaint Any error or complaint can be sent by mail, e-mail or telephone within 7 days of the delivery. The defective or damaged items must be returned in their original packaging, intact and complete. If your return is not due to our error, we will deduct the shipping costs from your refund. No items will be replaced or refunded if used, opened, damaged because of its utilisation, or if incomplete. Each return will be examined by KENOMAR S.A. – N.V. and she can decide the replacement or refund. Every refund will be made by bank transfer to the person and address mentioned on the order bill. NB: please note that no refunds or replacements can be given for books, technical books and cd’s. if not a real structural damage can be proven. 14. Property Ownership KENOMAR S.A. – N.V. remains the owner of the products until the effective and integral payment of the order has been made. The customer becomes responsible for the product after the reception. In the absence of payment, KENOMAR S.A. – N.V. can require by registered letter with acknowledgement of delivery the restitution of the articles at the customer’s expense. 15. Treatment of personnel information While ordering on the website, the customer allows KENOMAR S.A. – N.V. to collect personal information and to use them internally for the specific means of the business. This data is neither accessible nor shared with another company except KENOMAR S.A. – N.V. . The customer ordering on the website HOBBYDREAMS.EU from whom the personal data is collected is entitled to have access to and modify this data recorded in this file, by sending KENOMAR S.A. – N.V. an e-mail. 16. Linked Sites This website contains links to other sites on the internet that are owned and operated by third parties, and KENOMAR S.A. – N.V. is not responsible for the content, products, policies or practices of any linked site. In no way shall KENOMAR S.A. – N.V. be held liable, directly or indirectly, to anyone for any loss or damage resulting from the use of any linked site or the information accessed through a linked site. 17. Jurisdiction Belgian law only applies. For any litigation that cannot be resolved between the 2 parties, the Courts of the Liege judiciary territory only have jurisdiction. Both parts accept in this contract, electronic means as a proof such as email, back-up and so on. 18. Language In case of contradiction between the French, Dutch, German and English text, the French terms and conditions will prevail.
